Liability Waiver & Release

Last updated September 1, 2026. Booking or accepting any service from Sam's Helping Hands is your acknowledgment that you have read and agree to this waiver. It works alongside our Terms of Service and Booking Policy.

1. Your acknowledgment

You confirm you are at least 18, you are the owner or legal guardian of any pet or child receiving care, and you may agree to this waiver on behalf of your household. Booking a service — online, by phone, by text, or by email — counts as your electronic signature. If you do not agree, please do not book.

2. Assumption of risk

In-home and pet care carries inherent risks that cannot be fully removed: the natural behavior of animals (biting, scratching, escaping, illness, injury, or death); children's reactions to care or activities; slips, falls, and household accidents; and events outside our control such as weather, power outages, lockouts, or third-party acts. You voluntarily assume all such risks for yourself, your family, your pets, and your property.

3. Release and waiver of claims

You release and hold harmless Sam's Helping Hands and its owners, employees, contractors, and agents from any and all claims, demands, and causes of action arising from your use of our services, except to the extent caused by our gross negligence or willful misconduct. This release is intended to be as broad as North Carolina law allows. You agree not to sue or make a claim merely because you disagree with a policy, fee, scheduling decision, or outcome that was disclosed and agreed to here.

4. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of income, companionship, or emotional distress. Our total liability for any claim is limited to the amount you actually paid us for the specific service at issue.

5. Not a substitute for professional care

Our services are not veterinary, medical, legal, or counseling care, and we do not diagnose, treat, or prescribe. You remain responsible for securing veterinary care for pets and medical care for children or household members. In an emergency we will act reasonably to protect safety and contact you and emergency services.

6. Your property, pets & belongings

You are responsible for your home's condition and for keeping valuables, fragile items, and hazards out of reach. We take reasonable care but are not liable for loss or damage to belongings, or for a pet's illness, injury, escape, or passing from undisclosed conditions, pre-existing issues, or events beyond our control. You agree to carry appropriate homeowners or renters and pet insurance.

7. Indemnification

You agree to indemnify and hold us harmless from any claim, damage, or cost (including reasonable legal fees) arising from information you did not disclose or that was inaccurate, or from your breach of these terms.

8. Dispute resolution & arbitration

Any dispute will first be handled by direct, good-faith communication. If unresolved, you and Sam's Helping Hands agree to final and binding individual arbitration in Cumberland County, North Carolina, under AAA rules; either party may seek small-claims relief in local court. You and we waive the right to a jury trial and to any class or representative action. The arbitrator may not consolidate claims or preside over a class proceeding.

9. Governing law

This waiver is governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.

10. Changes to this waiver

We may update this waiver anytime; the posted version with its "last updated" date is in effect. Continuing to book or accept services after a change counts as acceptance.
